The Site offers a curated collection of travel essentials, including but not limited to Collapsible Cups, Luggage Tags, Passport Holders, and Toiletry Bags.
By accessing, browsing, or using this Site, placing an order, or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Refund and Returns Policy, all of which are incorporated herein by reference. We reserve the right to update or modify these Terms at any time without prior notice. 4. Products, Pricing, and Purchases
A. Product Descriptions and Availability: We strive to display product descriptions, images, colors, specifications, and prices as accurately as possible on the Site. However, we do not guarantee that the colors or details on your screen will be perfectly accurate, or that all products are always in stock. Products are offered subject to availability. We reserve the right to discontinue any product at any time. We may, at our sole discretion, limit the quantity of items purchased per person, per household, or per order.
B. Pricing: All prices listed on the Site are in Euros (€) and are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed. We are not responsible for typographical errors regarding price or product information. Shipping, handling, and any applicable taxes (e.g., GST, VAT) are additional charges, calculated and displayed at checkout.
C. Orders and Acceptance: Placing an item in your cart does not reserve that item or price. An order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, errors in product or pricing information, suspected fraud, or inaccuracies. If we cancel an order after your payment has been processed, we will issue a full refund to your original payment method.
D. Payment: We accept various payment methods as indicated at checkout. You represent and warrant that you have the legal right to use any payment method you provide. By submitting payment information, you authorize us to charge the specified amounts through our third-party payment processor.
5. Shipping, Returns, and Refunds
All orders are subject to our Shipping Policy and Refund and Returns Policy. Please review these policies carefully, as they form an integral part of this Agreement. You agree to pay all shipping and handling charges unless expressly stated otherwise. For international orders, you are solely responsible for any customs duties, taxes, or fees imposed by the destination country. We strongly emphasize that our Refund and Returns Policy strictly prohibits “refund-only” requests; a physical return of the item in its original condition is a mandatory prerequisite for any monetary refund, except in cases of confirmed defects or shipping errors. International delivery times are estimates and not guaranteed.
6. Intellectual Property Rights
The entire content of the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, product designs, and software, is the property of SG Travel Goods or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Site without our express prior written consent.
The phrases “Travel Smart, Pack Light. Gear Up, Explore Bright,” “Pack Light, Explore Far. Smart Gems, Smooth Journeys,” “SG Travel Goods,” and our product names are trademarks or trade dress of SG Travel Goods. You may not use any meta tags or any other “hidden text” utilizing our name or trademarks without our permission.
7. User Conduct and Prohibited Uses
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
- In any way that violates any applicable local, national, or international law or regulation.
- To transmit any material that is defamatory, obscene, offensive, hateful, or inflammatory.
- To impersonate or attempt to impersonate SG Travel Goods, an employee, another user, or any other entity.
- To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which may harm us or users of the Site.
- To use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
- To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
8. User-Generated Content
If you submit reviews, comments, photos, or other content to the Site (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or control all rights to the User Content you submit and that it is accurate, does not violate these Terms, and will not cause injury to any person or entity. We reserve the right (but not the obligation) to monitor, edit, or remove any User Content at our sole discretion.
9. Disclaimer of Warranties and Limitation of Liability
A. Disclaimer: THE SITE AND ALL PRODUCTS AND SERVICES OFFERED ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SG TRAVEL GOODS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
B. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SG TRAVEL GOODS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
OUR TOTAL, AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS, HOWSOEVER CAUSED, IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR PRODUCTS VIA THE SITE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED EUROS (€100).
10. Indemnification
You agree to defend, indemnify, and hold harmless SG Travel Goods, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.
11. Governing Law and Dispute Resolution
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved amicably within sixty (60) days, it shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on the parties.
12. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Refund and Returns Policy, constitute the sole and entire agreement between you and SG Travel Goods regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
13. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
